Terms of Service for the TransAdvocate Community
Effective Date: February 3, 2025
Thank you for joining the TransAdvocate Community (“the Platform”). The following Terms of Service (“Agreement”) govern your use of the Platform, which is operated by the Transgender Foundation of America (“the Foundation”). By accessing or using the Platform, you (“User”) agree to comply with and be bound by this Agreement.
Please read these terms carefully before using the Platform. If you do not agree to these terms, you must immediately cease using the Platform.
1. Age Restrictions
1.1 Eligibility: The Platform is intended for individuals who are at least 18 years of age. By using the Platform, you affirm that you are at least 18 years old or have the legal authority to enter into this agreement in your jurisdiction.
1.2 Parental Consent: If you are under the age of 18 but are at least 13 years old, you may access and use the Platform only with explicit consent from a parent or legal guardian. Users under 13 years old are not permitted to use the Platform.
1.3 Verification: We may request verification of age through various means, including but not limited to identity verification systems or submitting an age confirmation. If we determine that a User does not meet the age eligibility requirements, their access will be revoked.
2. User Content and Privacy
2.1 Confidentiality of Content: By participating in the TransAdvocate Community, you agree to keep all content shared within the Platform, including discussions, posts, personal stories, photos, and any other materials (“Content”), strictly private. You will not disclose, reproduce, or share any Content outside of the Platform without the express written consent of the original content creator.
2.2 Non-Disclosure: You agree not to share, distribute, or publish any private or personal information (either your own or that of others) that you access on the Platform outside of the community, unless otherwise permitted by the Platform’s features and functionality.
2.3 Ownership and License: You retain ownership of the Content you submit to the Platform. By submitting Content, you grant the TransAdvocate and the Transgender Foundation of America a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, display, distribute, and modify the Content for the purposes of promoting the Platform and supporting the Foundation’s mission.
3. Indemnification and Liability
3.1 Defense and Indemnification: By using the Platform, you agree to defend, indemnify, and hold harmless the TransAdvocate, the Transgender Foundation of America, its affiliates, employees, agents, and officers from any and all claims, demands, damages, or losses (including reasonable legal fees) arising out of or related to your use of the Platform, your Content, or your violation of any law or third-party rights.
3.2 Legal Defense: In the event that you bring any legal action or claim against the TransAdvocate or the Transgender Foundation of America, including but not limited to lawsuits, regulatory inquiries, or governmental action, you agree to bear all costs associated with defending such action. This includes, without limitation, attorney fees, court costs, and any settlements or judgments that arise from the dispute.
3.3 Limitation of Liability: The TransAdvocate and its parent organization, the Transgender Foundation of America, will not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from your use of the Platform, including any loss or damage to Content, loss of income, or any other personal or business-related damages.
4. Code of Conduct
4.1 Respectful Use: Users must adhere to community guidelines that promote a respectful, inclusive, and non-discriminatory environment. Harassment, hate speech, defamation, threats, and other forms of abusive behavior will result in removal from the Platform.
4.2 Prohibited Content: The following types of Content are strictly prohibited on the Platform:
- Content that is illegal, defamatory, or violates the rights of others.
- Content that promotes violence, discrimination, or hatred.
- Content that infringes intellectual property rights.
- Spam, viruses, or malicious software.
4.3 Termination of Access: We reserve the right to suspend or terminate your access to the Platform if you violate any terms of this Agreement, including failure to follow the community code of conduct or engaging in unlawful activities.
5. Modifications to Terms
The TransAdvocate reserves the right to modify or update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. By continuing to use the Platform after any modifications are made, you agree to abide by the updated terms.
6. Governing Law and Dispute Resolution
6.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of Texas, USA, without regard to its conflict of law principles.
6.2 Dispute Resolution: Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration, with the arbitration proceedings taking place in the state of Texas. Users agree to waive their right to a jury trial or class action.
7. Miscellaneous
7.1 Entire Agreement: This Agreement constitutes the entire understanding between you and the TransAdvocate regarding your use of the Platform. Any previous agreements or representations related to the Platform are superseded by this Agreement.
7.2 Severability: If any provision of this Agreement is found to be unlawful or unenforceable, the remaining provisions will remain in full force and effect.
7.3 Assignment: The TransAdvocate may assign its rights and obligations under this Agreement to any third party at its discretion. Users may not assign or transfer their rights under this Agreement.
By using the Platform, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you do not agree with the terms, please discontinue your use of the TransAdvocate Community immediately.
